TERMS AND CONDITIONS

1. SCOPE
These Terms and Conditions apply to all orders and contracts concluded through the online store operated by:

These Terms and Conditions apply in particular to the sale and provision of:
– digital content, in particular e-books and comparable digital products; and
– physical products, in particular printed books.
Any terms and conditions submitted by the customer shall apply only if 5LIBER-MANUFAKTUR has expressly agreed to them.

3. PRODUCT OFFER AND CONCLUSION OF CONTRACT
The presentation of products in the online store provides information about the products offered and constitutes an invitation to place an order.
The customer may select the desired product and add it to the shopping cart.
Before completing the order, the customer can review the information contained in the shopping cart and checkout and correct input errors.
By clicking the button in checkout that clearly indicates that the order involves an obligation to pay, the customer submits a binding order.
After the order has been received, the customer will receive an electronic order confirmation at the email address provided during checkout.
The contract is concluded when the order is electronically accepted by 5LIBER-MANUFAKTUR or when performance of the order begins.
For digital products, this may occur at the latest when the digital product or personal download link is made available.
For printed products, this may occur at the latest when the order is accepted for production or fulfillment.
The ordering process is handled through the Shopify e-commerce platform.
4. PRODUCTS
4.1 Digital Products
Digital products offered through the online store may include e-books and comparable digital content.
The specific file formats, content, scope, and technical characteristics are described on the relevant product page.
Digital products are not supplied on a physical medium unless expressly stated otherwise.
4.2 Printed Products
The online store also offers printed books.
Printed books may be produced on demand.
Production, fulfillment, and shipping of printed books may be carried out through Lulu Direct and fulfillment providers associated with Lulu.
The relevant format, binding, size, language, edition, and other product characteristics are described on the respective product page.
Minor variations resulting from printing, production processes, screen display, paper, color reproduction, or manufacturing tolerances do not constitute a defect where they are customary and reasonable.
5. PRICES
The applicable price is displayed on the respective product page and during checkout.
The total price displayed before the order is completed is decisive for the order.
Prices may be displayed in different currencies depending on the customer’s market, location, or Shopify settings.
For digital products, no physical shipping charges apply.
For printed products, shipping charges may apply and will be displayed during checkout where applicable.
Taxes, duties, or other charges required by law will be handled in accordance with the legal rules applicable to the respective order and, where required, shown during checkout.
For international orders, additional import duties, taxes, customs fees, or similar public charges may apply.
6. PAYMENT
The payment methods currently available are displayed during checkout.
These may include, in particular:
– Shopify Payments;
– credit and debit cards;
– PayPal;
– Shop Pay;
– Google Pay;
– other payment methods supported by Shopify.
Payment is generally authorized or collected as part of the ordering process.
Digital products are generally provided only after successful confirmation of payment.
Printed products are generally submitted for production or fulfillment only after successful payment confirmation.
Payment processing may be carried out by external payment service providers. Their respective terms of use and privacy policies may additionally apply.
7. DIGITAL PRODUCTS AND DELIVERY
Digital products are provided electronically.
After successful payment, the customer may receive a personal download link:
– by email;
– through a download page;
– through the order status page; or
– through another technical function provided by Shopify or a connected service.
The available file formats are described on the respective product page.
No postal or physical delivery takes place for digital products.
8. TIME OF DIGITAL DELIVERY
Digital products are generally made available shortly after successful payment confirmation.
Technical delays caused by payment providers, Shopify, internet connections, email systems, apps, or other technical services may result in the digital product being provided later.
If the customer does not receive a functioning download link within a reasonable period of time, the customer may contact:
9. TECHNICAL REQUIREMENTS FOR DIGITAL PRODUCTS
The customer is responsible for having a suitable device, internet connection, and software necessary to use the file formats provided.
PDF files can generally be opened using common PDF applications on computers, tablets, and smartphones.
EPUB files require an EPUB-compatible e-reader or suitable reading application.
Compatibility information is provided for general guidance only.
Actual functionality may depend on the customer’s device, operating system, software, settings, and third-party applications.
10. RIGHTS OF USE FOR DIGITAL PRODUCTS
Upon full payment, the customer receives a simple, non-exclusive, and non-transferable right to use the purchased digital product for personal and private purposes.
Unless expressly agreed otherwise, the customer may not:
– share the file or copies of it with third parties;
– resell the digital product;
– make the digital product publicly available;
– distribute the file through file-sharing platforms or comparable services;
– reproduce or commercially exploit substantial parts of the content without permission;
– present the digital product or parts of it as the customer’s own work.
Uses that are mandatorily permitted by law remain unaffected.
The purchase of a digital product does not transfer copyright or other exclusive intellectual property rights.
11. DOWNLOAD LINKS
A personal download link is intended only for the respective purchaser and may not be shared with third parties.
The number of available downloads may be technically limited.
Where a download limit exists, it may be displayed on the relevant download page.
Customers are encouraged to save the purchased digital product on their own device or suitable personal storage medium after successful download.
If a technical problem occurs with the download link, the customer may contact:
12. PRODUCTION AND FULFILLMENT OF PRINTED BOOKS
Printed books may be produced on demand through Lulu Direct and fulfillment services associated with Lulu.
Following successful payment, the order may be transmitted to the relevant production and fulfillment provider.
Production time is separate from shipping time.
Because production is carried out on demand, printed products may not be dispatched immediately after the order is placed.
The place of production may differ depending on the delivery destination, available production facilities, and fulfillment capacity.
5LIBER-MANUFAKTUR does not guarantee that every order will be produced at a specific printing facility or in a particular country.
13. SHIPPING OF PRINTED PRODUCTS
Printed products can only be delivered to destinations for which a shipping option is available during checkout.
Shipping charges depend on the destination and the shipping option available for the respective order.
Applicable shipping charges are displayed during checkout before the order is completed.
Estimated delivery times are estimates unless expressly stated otherwise.
Actual delivery times may be affected by:
– production times;
– destination;
– carrier delays;
– customs processing;
– public holidays;
– weather conditions;
– unusually high order volumes;
– technical or logistical circumstances outside our reasonable control.

14. SHIPPING ADDRESS
The customer is responsible for entering a complete and correct shipping address.
The customer should verify the shipping address before completing the order.
If an incorrect address has been entered, the customer should contact us as soon as possible at:
Once a printed order has entered production or fulfillment, changes to the shipping address may no longer be possible.
Where permitted by law, additional costs resulting from an incorrect or incomplete address attributable to the customer may be charged to the customer.
15. CUSTOMS, IMPORT DUTIES, AND TAXES
International shipments may be subject to customs procedures, import duties, taxes, or other charges imposed by the destination country.
Where such charges have not already been collected during checkout, they may be payable by the recipient.
5LIBER-MANUFAKTUR has no control over charges imposed by foreign customs authorities or other public bodies.
Mandatory legal information displayed during checkout remains applicable.
16. DAMAGED, DEFECTIVE, OR INCORRECT PRINTED PRODUCTS
If a printed product arrives damaged, defective, incorrect, or otherwise does not conform to the contract, the customer should contact:
The customer should provide, where possible:
– the order number;
– a description of the problem;
– photographs showing the product;
– photographs of the packaging where relevant.
Depending on the circumstances and applicable mandatory law, an appropriate remedy may include replacement, correction, price reduction, or refund.
Customers should not return printed products directly to Lulu, a printing facility, or another fulfillment provider unless specifically instructed to do so.
Mandatory statutory warranty and consumer protection rights remain unaffected.
17. CANCELLATIONS AND CHANGES TO PRINT ORDERS
Because printed books may enter production shortly after an order has been confirmed, cancellation or modification may no longer be possible once production or fulfillment has begun.
Customers who wish to request a change or cancellation should contact us as soon as possible.
A request does not guarantee that the order can still be changed or cancelled.
Mandatory statutory withdrawal or consumer protection rights remain unaffected.
18. WITHDRAWAL AND RETURNS FOR CUSTOMERS IN SWITZERLAND
Swiss law generally does not provide for a general statutory right of withdrawal or return for ordinary online purchases.
Unless expressly agreed otherwise, 5LIBER-MANUFAKTUR therefore does not grant an additional voluntary right of withdrawal, return, or exchange solely because a customer has changed their mind.
Mandatory statutory rights, in particular in the event of defective, damaged, incorrectly supplied, or otherwise non-conforming products, remain unaffected.

19. CONSUMERS IN THE EUROPEAN UNION
This section applies where the online store enables sales to consumers whose habitual residence is in the European Union.
EU consumers may have a statutory right of withdrawal for distance contracts in accordance with applicable consumer protection law.
Different rules may apply to physical goods and digital content.
For digital content supplied without a tangible medium, the right of withdrawal may cease where the statutory requirements for immediate performance and loss of the right of withdrawal have been satisfied.
Where corresponding consent is obtained during checkout, the consent and acknowledgement may be documented in connection with the order, including the date and time.
For printed goods, applicable statutory withdrawal rights remain unaffected.

20. DEFECTS AND TECHNICAL PROBLEMS WITH DIGITAL PRODUCTS
If a download link does not work, a downloaded file is corrupted, or the digital product cannot otherwise be provided as contractually agreed, the customer should contact:
5LIBER-MANUFAKTUR will make reasonable efforts to provide a functioning download or correct file.
Mandatory statutory warranty, conformity, and consumer protection rights remain unaffected.
21. CONTENT INFORMATION
Information, recipes, recommendations, quantities, preparation instructions, and other content contained in the products have been prepared with reasonable care.
Individual results may vary due to different ingredients, equipment, preparation methods, environmental conditions, or personal circumstances.
Customers remain responsible for the appropriate use of the content, in particular with regard to:
– allergies;
– intolerances;
– special dietary requirements;
– food safety;
– personal health considerations;
– other individual circumstances.
Mandatory statutory liability rights remain unaffected.
22. COPYRIGHT AND INTELLECTUAL PROPERTY
The digital content, printed books, texts, photographs, illustrations, graphics, layouts, designs, and other protected materials offered through the online store are protected by copyright and other intellectual property rights unless expressly stated otherwise.
Purchasing a printed book transfers ownership of the physical copy but does not transfer copyright or other intellectual property rights in the content.
Any use beyond the rights granted by law or these Terms and Conditions requires the prior permission of the respective rights holder.
Unauthorized reproduction, publication, distribution, resale of digital copies, or other unlawful use may result in civil and, where applicable, criminal consequences.
23. LIABILITY
5LIBER-MANUFAKTUR is liable in accordance with mandatory statutory provisions.
To the extent permitted by law, liability is excluded for damage arising exclusively from circumstances outside the reasonable control of 5LIBER-MANUFAKTUR.
Such circumstances may include, in particular:
– failures of internet or telecommunications services;
– external payment providers;
– Shopify;
– Lulu or fulfillment providers;
– shipping carriers;
– customs authorities;
– failures or incompatibilities of the customer’s device or software;
– other independent third-party systems.
This limitation does not apply where exclusion or limitation of liability is prohibited by mandatory law.
In particular, liability for intentional misconduct, gross negligence, or other claims that cannot legally be excluded remains unaffected.
24. DATA PROTECTION
Information regarding the processing of personal data can be found in the Privacy Policy published in the online store.
The operation of the online store involves Shopify and the payment, technical, fulfillment, and shipping service providers used for the respective order.
For printed products, this may include Lulu Direct and fulfillment providers associated with Lulu.
25. APPLICABLE LAW
The contractual relationship is generally governed by Swiss law.
For contracts with consumers, mandatory consumer protection provisions of the country in which the consumer has their habitual residence remain unaffected where such provisions apply under mandatory law.
26. JURISDICTION
Statutory rules regarding jurisdiction apply.
For consumer contracts, mandatory statutory places of jurisdiction protecting consumers remain unaffected.
Where legally permitted and where no mandatory consumer jurisdiction applies, jurisdiction shall be determined in accordance with the applicable laws at the registered location of 5LIBER-MANUFAKTUR.
27. CHANGES TO THESE TERMS AND CONDITIONS
5LIBER-MANUFAKTUR may amend these Terms and Conditions for future orders where necessary due to changes in business processes, technical developments, products, services, or legal requirements.
As a rule, the version of the Terms and Conditions in force at the time the contract is concluded applies to the respective order.
28. SEVERABILITY AND FINAL PROVISIONS
If individual provisions of these Terms and Conditions are or become wholly or partially invalid or unenforceable, the remaining provisions remain unaffected to the extent permitted by law.
Mandatory statutory rights of customers are not restricted by these Terms and Conditions.
